PRIVACY POLICY

This is the privacy policy of Tabit Technologies Pty Ltd ABN 15 665 107 497 referred to as ‘we’, ‘us’ or ‘our’.  The purpose of this privacy policy is to provide information about how we deal with and manage personal information. 

By using Our Services and/or providing your personal information to us, you consent to us handling your personal information in accordance with this Privacy Policy.  You should not provide any personal information about another individual to us, unless you have obtained that individual’s consent.

This privacy policy is in three parts as follows:

• Part A sets out some defined terms used in this Privacy Policy.

We may amend, modify or replace this Privacy Policy at any time, by publishing such amended, modified or replaced Privacy Policy on our website.  This Privacy Policy was last reviewed on 11 February 2025.

PART A – DEFINED TERMS

The following defined terms are used in this Privacy Policy:

• Business Customer means an entity that we supply Online Services to for its internal business purposes and/or to use for the supply of services to Consumer Users (an example of a Business Customer is a restaurant).
• Business User means an employee or other authorised user of a Business Customer who uses Online Services supplied to the Business Customer.
• Consumer User means a user of Online Services who is a customer or prospective customer of a Business Customer (an example of a Consumer User is a customer of a restaurant).
• Online Services means any service that we supply, or make available, in Australia which is provided via a website, on-line platform or mobile application.
• Online Service Users means collectively Business Users and Consumer Users.
• Privacy Act means the Privacy Act 1988 (Cth) (including the Australian Privacy Principles).

PART B – ANSWERS TO KEY QUESTIONS

What is personal information?

Personal information is defined in the Privacy Act as:

information or an opinion about an identified individual, or an individual who is reasonably identifiable:

whether the information or opinion is true or not; and

whether the information or opinion is recorded in a material form or not.

An example of personal information is an individual’s name and contact details.

The Privacy Act recognises certain types of personal information as sensitive information Examples of sensitive information about an individual include information about the individual’s:

• health;
• racial or ethnic origin;
• political opinions;
• membership of a political association, professional or trade association or trade union;
• religious beliefs or affiliations;
• philosophical beliefs;
• sexual orientation or practices; and
• criminal record.

Sensitive information can also include biometric information that is used for the purpose of automated biometric verification or biometric identification.

Why do we collect personal information?

We collect personal information where it is reasonably necessary for our functions or activities.  In addition to our core business activity of supplying Online Services, our functions and activities include:

• marketing our business;
• managing our business affairs;
• undertaking research to improve our business;
• obtaining goods and services from other businesses;
• employing staff; and
• complying with legal and regulatory obligations.

For what purposes do we use or disclose personal information we have collected?

If we collect personal information for a particular purpose, we may use or disclose that personal information for that purpose.  For example, if we collect the name and contact details of an Online Service User, we may use or disclose that personal information for the purpose of providing the relevant Online Service.

We may also use or disclose personal information for other secondary purposes including the following:

• conducting marketing and other promotional activities and for general business operations (for example, maintenance of our business records, compliance with our legal and insurance obligations and statistical purposes);
• where the personal information is contained in a document, record or database, and the document, record or database is provided, or made accessible, to another entity pursuant to a corporate reorganisation such as a merger, acquisition or takeover (including any potential corporate reorganisation where the recipient is subject to confidentiality obligations);
• where the individual has consented to the use or disclosure for the secondary purpose;
• the secondary purpose is related to (or in the case of sensitive information directly related to) the purpose for which the personal information was collected and the individual concerned would reasonably expect us to use or disclose the information; or
• the use or disclosure is required or permitted by law.

Do we disclose personal information outside Australia? 

We use subcontractors and service providers and have related entities who are located outside Australia, this includes in Israel and the USA.  We may disclose personal information to our subcontractors, service providers and related entities located outside Australia where we are legally permitted to do so.  

Is your personal information secure?

We take reasonable steps to securely store your personal information to ensure it is protected from unauthorised access, modification and disclosure, and from other types of misuse, interference and loss. 

We take reasonable steps to destroy or permanently de-identify your personal information when we no longer require it. We may retain your personal information for as long as necessary to comply with any applicable law, for insurance and corporate governance purposes, for the prevention of fraud and to resolve disputes.  Your personal information may also be retained in our IT system back-up records.

How can you access your personal information that we hold?

You may request access to your personal information held by us by emailing us at privacy-au@tabit.cloud.  We will provide access where we are required to do so under law.  In other cases, we may provide access at our discretion and we reserve our right not to provide access.  We also reserve the right to recover our reasonable costs of providing you with access to your personal information held by us. 

What should you do if you believe we hold personal information about you that is wrong or you wish to complain about how we have handled your personal information?

If you believe that we hold personal information about you that is wrong (which includes inaccurate, out of date, incomplete, irrelevant or misleading), or you wish to complain about how we have handled your personal information, you should contact us at privacy-au@tabit.cloud. 

If you have complained to us about how we have handled your personal information, and you believe that we have not satisfactorily resolved your complaint, you may wish to contact the Office of the Australian Information Commissioner (https://www.oaic.gov.au/).

PART C – ONLINE SERVICE USERS

We handle the personal information of Online Service Users in accordance with Part B of our Privacy Policy.  This Part C of our Privacy Policy includes additional information about how we handle personal information that we collect in the course of supplying Online Services.  In this Part C, a reference to ‘you’ is to an Online Service User.

What personal information do we collect from Online Service Users?

The precise personal information we collect will depend on the nature of the Online Service and what information the user choses to provide to us.  If we are unable to collect the personal information we require, or the information provided is incorrect or incomplete, this may affect our ability to provide the Online Services to you.

In general, we may collect the following personal information:

• Registration data – this is information that you need to provide to us in order to register for the Online Service. This will include your name and contact details (e.g. email and phone number).  In the case of a Business User, this will also include your job title.
• Other personal information that you supply to us – for example, this could include a profile picture and/or your preferences in relation to certain services.
• Geo location data – depending on the nature of the Online Service, and subject to your device permission settings (i.e. whether or not you allow your geo location data to be collected) we may collect geo location data.
• Payment Data – Depending on the nature of the Online Service, you may be able to make a purchase through the service. Where this occurs, we may collect information related to the purchase, such as the last four (4) digits of your credit card number (stored as a token). We only use and retain such financial information to complete payments, and such information is collected solely for the purpose of transaction approval and the transfer of funds.
• Usage information – we may collect information about your usage of the Online Service.
• If you use our Online Services by logging in through a third-party login/account registration service (such as Facebook or Gmail), we may also receive Personal Information about you as provided by such third-party service, such as: your display name, email address, phone number, photos, and other information that you have approved may be shared with us.

We also use automated processes that collect other information during your use of our Online Services.  This information is related to your computer or mobile device, such as, the operating system, IP address, device ID and browsing history.  See further below under ‘What automated data collection tools do we use and how can you manage them?‘

There may be features of our Online Services that enable you to post information that can be seen by other users of the service (for example restaurant reviews).  If you chose to include any of your personal information in a post to other users, you acknowledge that we do not have control over the collection or use of that personal information by other users of our service who may have access to the post. 

Our Online Services may contain links to third party sites. We are not responsible for the privacy, security or handling of your personal information via those sites.  You should review the privacy policies and terms of use for those sites before you visit them.

Do we collect sensitive personal information from Online Service Users?

We may collect sensitive personal information in some limited circumstances, for example:

• Information about health allergies that a Consumer User chooses to disclose to us as part of their service preferences.
• Biometric data in the form of facial images of a Business User for identity verification purposes.

Where we collect sensitive personal information, we will only use or disclose it for the purpose for which it was collected or as otherwise permitted under the Privacy Act.

Who do we disclose personal information of Online Service Users to?

We may disclose your personal information to our:

• Related entities – this includes Tabit Technologies Inc and Tabit Technologies, Ltd.
• Partners, Service providers, and subcontractors.
• Relevant Business Customers (where you are a Consumer User).

We may also disclose personal information to other entities where this is required by law.

Do we use or disclose personal information we collect from Online Service Users for direct marketing?

If you are a user of our Online Services, we may use and/or disclose the personal information you have provided to us for the purpose of providing information to you about our products and services and the products and services of third parties, unless you have told us that you do not wish us to.   If you do not wish us to use your personal information for the purpose of direct marketing, please contact us at support-au@tabit.cloud.

Even if you opt out from us using your personal information for direct marketing, some of our Online Services may still include advertisements which do not require the use of any of your personal information.

What automated data collection tools do we use and how can you manage them?

We and/or our service providers and/or subcontractors use Google Analytics and other tools to collect information about the use of our Online Services and to analyse that information. The information these tools collect includes how often a user visits a site, what pages they visit, and what other sites the user has visited. These tools use cookies and similar technologies. Cookies are text files that contain small pieces of data that are used to identify a computer or device. For convenience, we use the term “cookie” to refer to cookies as just described as well to all similar technologies (including local storage).

We use analytic tools and cookies for a number of reasons, including to improve our Online Services, better understand our customers’ use of our Online Services, help personalize our customers’ experience and personalize the ads we serve to them.  The specific names and types of cookies we use in connection with our Online Services may change from time to time. However, the cookies we use generally fall into one of the following categories:

Necessary	These cookies are necessary in order to allow a site to work correctly. They enable a user to access a site, move around, and access different services, features, and tools. Examples include remembering previous actions (e.g. entered text) when navigating back to a page in the same session. These cookies cannot be disabled.
Functionality	These cookies remember your settings and preferences and the choices you make (such as language or regional preferences) in order to help us personalize your experience and offer you enhanced functionality and content.
Performance	These cookies can help us collect information to help us understand how you use our Online Services, for example whether you have viewed messages or specific pages and how long you spent on each page. This helps us improve the performance of our Online Services.
Analytics	These cookies collect information regarding your activity on our Online Service to help us learn more about which features are popular with our users and how the service can be improved.
Advertising	These cookies are placed in order to deliver content, including ads relevant and meaningful to you and your interests. They may also be used to deliver targeted advertising or to limit the number of times you see an advertisement. This can help us track how efficient advertising campaigns are, both for our own services and for other websites. Such cookies may track your browsing habits and activity when visiting our Online Services and those of third-parties.

How to adjust your preferences

Most Web browsers are initially configured to accept cookies, but you can change this setting so your browser refuses cookies or informs you when a cookie is being sent. In addition, you can delete any existing cookies at any time. However, some features of the Online Services may not function properly when cookies are disabled or removed. For example, if you delete cookies that store your account information or preferences, you will be required to input these each time you visit.

By changing your device settings, you can prevent your device’s ad identifier being used for interest-based advertising, or you can reset your device’s ad identifier. Typically, you can find the ad identifier settings under “privacy” or “ads” in your device’s settings, although settings may vary from device to device. Adjusting your preferences as described does not mean you will no longer receive advertisements, it only means the advertisements that you do see will be less relevant to your interests.

How do we use aggregated data and statistical information?

Where you provide us with Personal Information, we may de-identify the information and combine it with other de-identified data that we may use for the purpose of statistical analysis.  Statistical Information helps us to understand trends and customer needs so that new products and services can be considered and so that existing products and services can be improved. Statistical Information is anonymous and aggregated. We may share such statistical information with third parties at our discretion.
